Following the running of race 3, the Speights Maiden, Mr Lammas was charged with excessive use of the whip under rule 638 (3) (b).  The information alleged that “rider B Lammas the rider of ONE COURT CAT used his whip excessively manner prior to 200m”.



Following the running of race 3, the Speights Maiden, Mr Lammas was charged with excessive use of the whip under rule 638 (3) (b).  The information alleged that “rider B Lammas the rider of ONE COURT CAT used his whip excessively manner prior to 200m”.

Rule 638 (3) (b) states “A rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper”

Mr Lammas indicated on the information he admitted this breach of the rules and he confirmed this at the hearing.  He also agreed that that he understood the charge and the rule it was laid under.  As the breach of the rule was admitted the charge was proven.

Stipendiary Steward Mr Neal showed the film and said that after coming round the home turn into the straight Mr Lammas, who was in the lead, struck his mount 9 or 10 times times without a break prior to the 200 metre mark which was outside the guidelines for use of the whip.  Mr Lammas agreed he did strike the horse too many times prior to the 200m mark but he then stopped using the whip.  Mr Lammas also confirmed that he knew the “6 on/6 off” guideline in relation to the use of the whip prior to the 200m mark.

Penalty Submission

Mr Neal said Mr Lammas had been charged under this rule on 24 September 2009 at Otaki and he was fined $200.  He submitted that Mr Lammas was in a prominent position rounding the home turn and was using his whip to encourage his horse over the final stages and he has ended up running second.  However, it might be seen that in using the whip in an excessive manner he was obtaining an advantage when compared to other jockeys who rode within the guidelines.   He said Mr Lammas’ use of the whip on this occasion was not acceptable and did not comply with the “6 on/6 off” guidelines. He thought the offence could be dealt with by the imposition of a fine in the region of $300.  Mr Lammas had no comments to make on penalty.

In coming to a decision on penalty the Committee considered the video film of the incident and all the submissions put before it. We agree Mr Lammas did strike his horse 9 or 10 times prior to the 200m mark and that such the use of the whip is excessive. We have taken into account Mr Lammas’ admittance of the breach but also that this is his second charge under this rule in a month.  We have also taken into account other recent penalties imposed for other breaches of this rule and believe on this occasion a fine of $300 is the appropriate penalty.
