Following race 7 an Information was filed pursuant to Rules 856(1), 858(1)(a) and 523(3) when it was alleged by the informant, Mr A Coles, that Mr D Hain, the rider of SHANGHAI DEVIL, failed to weigh-in for fifth place.

DECISION & REASON:
--Following race 7 an Information was filed pursuant to Rules 856(1), 858(1)(a) and 523(3) when it was alleged by the informant, Mr A Coles, that Mr D Hain, the rider of SHANGHAI DEVIL, failed to weigh-in for fifth place.
--Mr Hain admitted the charge and was represented by trainer Mr L Noble.
----Mr Hain offered little in explanation, but simply forgot to weigh-in.
----Mr Noble said in Mr Hain's defence he was a good boy and was remorseful.
----Mr Coles said there was heavy congestion around the weigh area which could have contributed to Mr Hain's lapse in concentration. He produced Mr Hain's record which showed one other charge under this Rule, and that was 3 years ago. He believed it was at the lower end and asked the Committee to consider Mr Hain's guilty plea.
----The Committee considered all evidence and took into account Mr Hain's guilty plea and his record. They pointed out to Mr Hain it was his responsibility to weigh-in, even allowing for the fact of the congestion at the weigh-in area. Accordingly we impose a fine of $250 and order Mr Hain's riding fee be forfeited, and SHANGHAI DEVIL be disqualified.
