DECISION AND REASONS:
--Stipendiary Steward Mr S. C. Ching laid an information pursuant to Rule 508(2) alleging Licensed Trainer Mr R. R. Donnelly failed to declare a rider, by the time prescribed, for his horse "Pacifique" in Race 1. This breach was admitted and Mr Donnelly had indicated on the Information that he did not wish to attend the hearing.
--Stipendiary Steward Mr Davidson advised the Committee that a rider had not been declared by 4-00pm on Wednesday 19 December 2007, which was the deadline. Notification of a rider was made by the defendant at 4-30pm. Mr Davidson also advised that the defendant had already had the benefit of a warning in relation to a breach of this Rule.
--Penalty: Mr Davidson advised that a fine of 50-00 was usual for a first breach of this Rule. We were aware that a fine of $50-00 was the usual penalty, and accordingly Mr Donnelly was fined the sum of $50-00.
