Films of the alleged incident were shown to the Committee, the films clearly showed Mr Saad continuing to ride his mount with the whip whilst on an inward movement, and go over onto Slavonic Danz whose rider Mrs Allpress had to check out of a potentially dangerous situation.

Mr Hrstich nor Mr Saad wished to give their interpretation of the films. Mr Hrstich did however ask the Committee to note that Mr Saad had checked off Mrs Allpress's mount when he realised what had happened.

Mr Goodwin said in his opinion the incident was not minor and warranted a term of suspension.

Mr Saad had not previously been charged under this rule.

When arriving at a penalty the Committee took into account Mr Saad's admission of the breach and his good riding record, however these factors were outweighed by the severity of the check to Slavonic Danz and they felt a term of suspension was warranted.

Mr Saad was suspended from the conclusion of racing 2.12.06 * until the conclusion of racing on the 9.12.06 (* in effect 3 days).
