Mr Bullard admitted a breach of rule 638(1)(d) in race 9 in that he allowed his mount HOLD IT HARVEY to shift outwards near the 350 metre mark when not sufficiently clear of COUP BLOOMSBURY (Ms L Allpress), which was checked. We thus find the charge proved.
--We have viewed the videos of the incident and find that it was a sharp outwards movement from Mr Bullard in an attempt to obtain a run for HOLD IT HARVEY, which was full of running and was finishing on well. Mr Bullard’s actions inconvenienced Ms Allpress on COUP BLOOMSBURY, and also Mr Moseley on AUSIEAUSIEAUSIE.
--As Mr Oatham says, there was an element of desperation in Mr Bullard’s actions and there was a very real possibility that HOLD IT HARVEY could have clipped heels with COUP BLOOMSBURY. Mr Oatham’s assessment of the breach was that it was mid range at the higher end. We agree with this assessment, despite Mr Bullard emphasising to the Committee that the movement was only for 1 stride and that Ms Allpress was not that badly inconvenienced.
--We believe there was a safety issue on this occasion and we also take into account that this was Mr Bullard’s 2nd breach of this rule today. However, we also give credit for his ready admission of the breach.
--Mr Oatham asks for 2 weeks’ suspension and, as Mr Bullard went on to win the race, that the Committee impose a fine of $1000. Mr Oatham emphasised that this was a Group 3 race with a winning stake of $47,500. Mr Bullard’s percentage is 5%. We take into account Mr Bullard’s limited opportunities as a South Island jockey, and, in particular, his inability to make large sums from riding percentages. We believe a fine of $750 is appropriate and further suspend Mr Bullard from riding at the end of racing on 19 February up to and including 4 March. This will permit Mr Bullard to ride at the 2 day Central Otago circuit. Mr Bullard was reminded in no uncertain terms of his obligations to his fellow riders under the Rules of Racing. Mr Bullard indicated that he acknowledged and understood the concerns of the Committee.
