DECISION AND REASON
--Following the running of Race 3, Mr Ching, the Stipendiary Steward, preferred a charge against Mr B Hibberd alleging a breach of Rule 871(1)(d) - careless riding against Mr B Hibberd.
--It was alleged that "Bubbles of Kash" (B Hibberd) moved inwards when not sufficiently clear causing "Wilkie's Wonder" (K Williams) and "Saint Iris" (L Callaway) to check. The incident happened at the 1400 metre mark (approximately).
--Mr Hibberd pleaded guilty to the breach of the rule.
--Mr Ching showed the video evidence of the incident. The evidence showed Mr Hibberd moving across the field at the start. There was crowding to horses running near the rail, namely "Wilkie's Wonder" and "Saint Iris". Mr Hibberd said that he heard Ms Kylie Williams, the rider of "Wilkie's Wonder" call out but he did not notice Mr Callaway in behind Ms Williams. He stated that his horse got "a bit lost" in front.
--PENALTY
--We have given careful consideration to the fact situation which led to the bringing of this charge. Mr Hibberd allowed his mount to move across the paths of two horses when he was not sufficiently clear. His actions caused a check to both horses. Mr Hibberd is an experienced rider and no doubt has been in the same position that Mr Callaway and Ms Williams were placed in at some time during his riding career. Mr Hibberd will be critically aware of the extent of the danger to those other horses that his actions caused.
--Thus, we must conclude that Mr Hibberd's carelessness was at the higher end of the scale. We note Mr Hibberd's explanation that his horse got "a bit lost" out in front but nevertheless, he heard Ms Williams call out and it appears that he did nothing to relieve the pressure.
--Therefore, we impose a suspension, as it is the only appropriate penalty in the circumstances. We commend Mr Hibberd for his good riding record and his early admission of guilt and his candid and honest approach during the hearing.
--The starting point for this suspension must be three days, but having regard to the mitigating features referred to above, we allow a discount and therefore the suspension will be for two days only. Mr Hibberd is suspended from the conclusion of racing on Saturday 12th November until the conclusion of racing on 25th November.
