Following race 6 an information was filed pursuant to Rule 858(1)(c) when it was alleged by the Informant, Mr J Oatham, that Mr T Harris, the rider of WINSOME KASH, deliberately touched a person prior to weighing in.

Following race 6 an information was filed pursuant to Rule 858(1)(c) when it was alleged by the Informant, Mr J Oatham, that Mr T Harris, the rider of WINSOME KASH, deliberately touched a person prior to weighing in. Mr Harris admitted the charge.

Mr Oatham in his statement said that immediately after the horses returned to the weigh-in enclosure and after the jockeys dismounted, he noticed Mr harris, who rode the winner WINSOME KASH, put out his hand and shake hands with one of the owners. He said Mr Harris instigated the incident. He said that since the Ellerslie incident involving Mr Harris (Senior) and Mr Colgan, Mr C George, Chief Stipendiary Steward, sent out a circular on 6 March, reminding riders of their obligations under this particular Rule. Mr Oatham had also spoken to Mr T Harris regarding a similar type incident at a previous meeting.

Mr Harris in admitting the breach said he was not thinking, but also said he was not aware of the circular sent out.

Mr Walker, representing Mr Harris, said he observed Mr Sweeney, after his first win back at Tauranga last Saturday, give a high 5 to a connection of the winner, and all he wanted was consistency in such matters.

PENALTY:

Mr Oatham submitted a fine in the vicinity of $300 - $500 was appropriate.

Mr Harris and Mr Walker had nothing further to add.

The Committee considered all submissions and before imposing a penalty explained to Mr Harris the importance of jockeys' obligations when weighing in. The Committee believed a fine was the appropriate penalty, but it was important a message be sent to the industry that offences such as these are not to be condoned. Accordingly a fine of $350 is imposed.
