CHARGES:
--Following race 7 an information was filed pursuant to rule 638 (1) (d). The informant Mr Oatham alleged that Mr H Kasim permitted his mount CANNYMAC to shift outwards near the 300 metres when not sufficiently clear of KEEPA LADY (S Spratt) which was checked.

FACTS:
--Mr Coles demonstrated the video films and pointed out Mr Kasim riding CANNYMAC racing in a 6 wide position approaching the 300 metres. From this point Mr Kasim started drifting out eventually taking the line of KEEPA LADY (S Spratt) when only a bare length clear. Mr Coles said Miss Spratt anticipated what was going to happen which lessened the interference.

--Mr Kasim said he was having some difficulty with his mount after turning for home as it kept wanting to hang out.

Mr Clarken on behalf of Mr Kasim said CANNYMAC was a tricky horse to ride and as well as hanging appeared to over react to a slight outward movement form the horse on his inside.

SUBMISSION(s) ON PENALTY:
--Mr Oatham produced Mr Kasim’s record which showed 3 charges of careless riding in the last 12 months. He considered this a good record for the number of rides he has. However Mr Oatham said on this occasion Mr Kasim had continued to ride out without attempting to straighten his mount. He submitted that Mr Kasim’s carelessness was at the low end.

Mr Kasim told the committee he had commitments until the conclusion of racing at Gisborne on 7 November, 2010.

Upon questioning from the committee he confirmed that he had recently ridden in the South Island and intended doing so when able to get rides.
----
REASON(s):
--The committee carefully considered all evidence and submissions before imposing an appropriate penalty. Mitigating factors are Mr Kasim’s admission of the breach, his good record and the video evidence of his mount wanting to hang out. However it was also evident that Mr Kasim kept riding forward without taking any corrective action with the result that he was not the required distance clear of Miss Spratt when taking her line.
--Taking all the above factors into account the committee considers Mr Kasim’s breach is at the low end of carelessness.

PENALTY:
--Accordingly we impose a suspension on Mr Kasim from riding in races which is to start after racing on 7 November and conclude after racing on 12 November (4 riding days)
