Following the running of Race 7, the New Zealand 2000 Guineas, Stipendiary Steward Mr J. P. Oatham filed an information pursuant to Rule 638(1)(d) alleging Jockey L. M. Robinson rode carelessly when he permitted his mount ”Summer Surprise” (11) to shift inwards approximately 100 metres after the start  when not sufficiently clear of “Corsage” ridden by J. McDonald.

Following the running of Race 7, the New Zealand 2000 Guineas, Stipendiary Steward Mr J. P. Oatham filed an information pursuant to Rule 638(1)(d) alleging Jockey L. M. Robinson rode carelessly when he permitted his mount ”Summer Surprise” (11) to shift inwards approximately 100 metres after the start  when not sufficiently clear of “Corsage” ridden by J. McDonald.

Mr Robinson had indicated on the information that he admitted this breach of this Rules, and he confirmed this at the hearing.  Mr Robinson also acknowledged that he understood the Rule and the charge.

Stipendiary Steward Mr McLaughlin illustrated this incident by means of video coverage, and showed that Mr Robinson had moved inwards as described in the information.  In relation to the facts of this matter Mr Robinson said that his horse was inexperienced and green [this was its 4th start] and at the time he thought he was clear, and he had taken corrective action, but this was too late.

Penalty:

In relation to penalty Mr Oatham advised that Mr Robinson has two recent convictions for careless riding in August and October this year.  He assessed this breach as being mid – range and also accepted that the horse was inexperienced.  Mr Robinson’s admission should also be taken into account.  However this was a Group 1 $1,000,000-00 race and a three week suspension and a fine of between $500-00 and $1000-00 was recommended.

Mr Robinson said that he would like to have the suspension delayed until after 14 November 2009, but had no other relevant submissions to make.

We adjourned to consider the matter of an appropriate penalty, and on returning to the Enquiry Room we gave the following oral decision.

--

“In relation to penalty we take into account –

--

- The admission of the breach.
- The breach was mid – range.
- Mr Robinson did take remedial action, although too late.
- The horse was inexperienced and green.

--

On the other hand we take into account –

--

- This was a Group 1 $1,000,000-00 race.
- Mr Robinson’s two recent previous convictions.
  
Mr Oatham has recommended a suspension of three weeks and a fine of between $500-00 and $1,000-00. 

--

Mr Robinson has asked that any suspension be delayed until after 14 November 2009.

--

We are satisfied that a three week suspension is appropriate and this will commence after the completion of racing on 14 November 2009 and end after the completion of racing on 5 December 2009.  In addition Mr Robinson is fined the sum of $1,000-00.”

Note:

--

When giving the oral decision the three week period was wrongly stated to end after 7 December 2009, and this error has been corrected.  This error had no material effect on the suspension.
