DECISION AND REASONS:

--

An information was lodged by Stipendiary Steward Mr J Muirhead, against Miss A Matthews, driver of TYLER?S IMAGE, alleging a breach of Rule 869(4) & Passing Lane Regulations, in that she failed to maintain as straight a course as possible with her horse parallel to the running line in the home straight, thus denying WESTBURN SPLASH full access to the passing lane. Miss Matthews admitted the breach and was present at the hearing, assisted by Mr S Phillips, trainer of TYLER?S IMAGE.

Mr Muirhead asked that the evidence given at the associated protest hearing be used for this hearing. Mr Muirhead said that Miss Matthews had allowed her horse to move about three-quarters of a sulky width into the passing lane in the home straight. He said that she had a clear driving record and he recommended either a fine of $250 or a suspension for two days.

Miss Matthews said she accepted the comments of Mr Muirhead and that she would prefer a suspension. Mr Phillips suggested that a one-day suspension would be sufficient.

In fixing penalty the Committee took into account the following matters:

1. The guilty plea.

  3. Miss Matthew's acceptance of those submissions.
  4. --
  5. Miss Matthew's preference for a suspension.
  6. --
  7. The submissions of Mr Phillips.

  11. The offending was at the lower end of the scale.

Having balanced those matters, the Committee suspended Miss Matthew's horsewoman's driving licence for two days ? up to and including racing on the 4th August 2006.
