An Information lodging a protest into Race 8 was laid by Stipendiary Steward Mr T Taumanu against Horse 1 RIVER BELLE (Driver Mr T Herlihy) placed 2nd by the Judge, alleging that by running over the last marker peg in breach of Rule 869(7A)(b) immediately prior to the passing lane in the run home RIVER BELLE had gained an unfair advantage.



An Information lodging a protest into Race 8 was laid by Stipendiary Steward Mr T Taumanu against Horse 1 RIVER BELLE (Driver Mr T Herlihy) placed 2nd by the Judge, alleging that by running over the last marker peg in breach of Rule 869(7A)(b) immediately prior to the passing lane in the run home RIVER BELLE had gained an unfair advantage.

Mr Herlihy appeared representing the connections of RIVER BELLE.

Video footage of the closing stages of the race clearly indicated that as RIVER BELLE moved into the passing lane the sulky crossed over the final marker peg.  The stipendiary stewards submitted that by doing so had allowed an unfair advantage over the field by progressing into the passing lane too early.

Mr Herlihy submitted that he clearly had not gained an advantage as the horse in front had stopped badly with the horse on the outside going past it.  He had lost momentum and suggested he had lost a length and a half because of the behaviour of the leading horse.  His horse had improved after being impaired and had run second by three quarters of a length.

Decision and Reasons
The Committee is satisfied that the movement inwards by RIVER BELLE in the closing stages of the race over the final marker peg immediately prior to the passing lane was a breach of Rule 869(7A)(b).  However in breaching this rule we are satisfied that no real advantage was gained as immediately prior to the breach RIVER BELLE had lost momentum because of the actions of the preceding horse before recovering to finish strongly for second.  In essence the breach does not warrant a change in the Judges placings and accordingly the protest is dismissed.
