CHARGES:

Following race 8 an Information was filed pursuant to Rule 614(2).The informant, Stipendiary Steward Mr Williamson alleged, that Mr Dalley was neglectful in preparation and mounting of his saddle.

FACTS:

--

Mr Williamson said going to the barriers the gear failed on the horse THE MISSING LINK ridden by Mr Dalley resulting in him been dislodged. Upon investigation it was found that Mr Dalley’s stirrup leather was not through the tree of the saddle it was only through the safety ring which is only held on by stitches. This incident forced the late scratching of THE MISSING LINK with the connections carrying the costs of float and starting fees.

Mr Dalley when invited to make submissions said it was an error on his behalf.

SUBMISSIONS ON PENALTY

--

Mr Williamson said this was the first time a jockey had been charged with this offence.  He said it was negligence on Mr Dalley’s part and was grateful the gear did not give way mid race. He submitted a fine of $250.00 would be appropriate and asked the Committee to consider Mr Dalley forgo his riding fee.

Mr Dalley when invited to make submissions on penalty had nothing to say.

REASONS:

--

The Committee carefully considered all evidence and submissions as presented. Mitigating factor is Mr Dalley’s admission of the breach.  We highlighted to Mr Dalley that he was extremely fortunate he did not injure himself in the incident. However if the stirrup had broken during the race this would have put the safety of his fellow rider’s at risk.

PENALTY:

--

After taking all the above factors into account we impose a fine of $250.00. Under these circumstances we grant the submission of the stewards that Mr Dalley forfeit his riding fee, because of his negligence.
