DECISION & REASON:
Following race 5 an information was filed pursuant to Rule 631(6)(c).  This was to request a ruling arising from the starting gate for DAMUSE (C Ormsby) failing to open with the other gates.  The Starter, Mr J Humphries, gave evidence and said the runner next door to DAMUSE was being held by an assistant, when it lent on the side of the gate belonging to DAMUSE causing its gate to be very slow.

Following race 5 an information was filed pursuant to Rule 631(6)(c).  This was to request a ruling arising from the starting gate for DAMUSE (C Ormsby) failing to open with the other gates.  The Starter, Mr J Humphries, gave evidence and said the runner next door to DAMUSE was being held by an assistant, when it lent on the side of the gate belonging to DAMUSE causing its gate to be very slow.

Mr C Ormsby, rider of DAMUSE, said his gate was slow to open and he had to force his way out.

DECISION:
The films clearly showed that the gate belonging to DAMUSE remained shut when all the others clearly opened.  Accordingly we are satisfied that DAMUSE was denied a fair start through mechanical failure of the gates and we declare DAMUSE a non-starter.
