| -- DECISION AND REASONS: --Information 65390 alleged that M. Nicholas committed a breach of Rule 869(2)(a) for using the whip excessively when driving SILKY OAK out over the concluding stages of the race. The breach was admitted and Mr Nicholas indicated on the information that he did not wish to be present. He recorded that he wished the Committee to have regard to the following explanation: --"Silky Oak ran second at CTC under a solid drive. Next start at ATC she ran 5th under a soft drive. The owner felt she had not tried due to heart rate. We felt a hard drive was to be tried again. In retrospect it was too hard. Would the J.C.A. take into account my guilty plea in setting the fine?" --Mr Taumanu explained, in the absence of Mr Muirhead, that this matter had been adjourned from the previous week and in view of the explanation offered by Mr Nicholas, which was accepted by the Stipendiary Stewards, that a fine of $200.00 be imposed as a first offence. He produced his record showing no previous charges. --The Committee accepted the explanation by Mr Nicholas as recommended and ordered that a fine of $200.00 be imposed. ------ -- --
