Following race 4 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr C George, that Mr B Herd, rider of MARY ELLEN, allowed his mount to shift outwards when not sufficiently clear

DECISION & REASON:

Following race 4 an Information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr C George, that Mr B Herd, rider of MARY ELLEN, allowed his mount to shift outwards when not sufficiently clear taking the rightful line of running of VOLSCAR (S Collett) who had to be checked as a result.

Mr Herd did not admit the breach.

Mr Oatham demonstrated all the video films and showed that at the 200 metre mark MARY ELLEN (B Herd) moved outwards into the line of VOLSCAR ridden by S Collett. Mr Oatham pointed out that Mr Herd turned his mount's head outwards and continued to ride forward causing interference to VOLSCAR. Mr Oatham conceded there was some inward movement from DIPPED ?N? GREY (D Bradley), but this had little effect on the interference to VOLSCAR. He also believed TATLOCK was well clear of Mr Herd and did not contribute to the interference.

Miss Collett, rider of VOLSCAR, gave evidence and said that at the 200 metre mark there was outward movement from MARY ELLEN and some minor inward movement from DIPPED ?N? GREY. She said the check she received was from MARY ELLEN moving out into her line.

Mr Herd gave evidence and said he was on TATLOCK?S heels and had to move out to avoid clipping heels. He also said Mr Bradley had moved in.

After hearing all the evidence the Committee prefers the evidence of Mr Oatham and Miss Collett. We conclude that Mr Herd did angle his mount out when not sufficiently clear of VOLSCAR. In doing so he caused interference to this runner taking its rightful line of running. We do not accept that Mr Herd's assertion that TATLOCK and DIPPED ?N? GREY contributed to the incident. Accordingly we find the charge of careless riding proved to the required standard.

Mr George produced Mr Herd's record which showed that Mr Herd had only had one charge under this Rule, and that was in July 2006. He believed this particular offence was not at the higher end of careless but believed a suspension was warranted. He suggested a range of 3 ? 5 days.

Mr Herd gave his riding commitments for the Committee to consider.

The Committee took all submissions into account and determined a suspension was the correct penalty. Accordingly we impose a suspension to start after racing on 14 February and conclude after racing on 22 February (4 days).
