DECISION & REASON:
--An information lodged by Stipendiary Steward Mr J Muirhead against Mr M Purdon, driver of AFFAIRS OF STATE alleging a breach of Rules 869(4) and (6)(b)(c) ? Push Out ? in that he improved his horse from two wide to three wide with about 1100m to run forcing RUNNING WITH FIRE driven by Mr T Shaw to race wider on the track.
--Mr Purdon admitted the breach and did not wish to be present at the hearing.
--Mr Muirhead demonstrated the incident by use of the video film. This was a clear breach of the Push-Out rule. Mr Purdon actually looked to his left and saw the other horse coming forward but still pushed out. RUNNING WITH FIRE was forced to race four wide until AFFAIRS OF STATE reached the parked out position and thereafter was forced to race three wide. RUNNING WITH FIRE finished in fourth place about one and a half-lengths from second place. In the Committee's view had this breach not occurred it is very likely RUNNING WITH FIRE would have finished second or third.
--Penalty:
--Mr Muirhead said that Mr Purdon had no relevant breaches of the rules and that as this was a premier meeting a fine of $400 was appropriate. In fixing penalty the Committee took into account the following matters:

- The stake payable for the race - $20,000 ? this was a premier night's racing --
- The offending is in the upper end of the scale of seriousness
Balancing those matters, the Committee imposed a fine of $400.
