At the meeting held on 14th March 2008 the Stipendiary Stewards lodged an Information against licensed trainers, M & T Stokes, under Rule 868 (5) (a) alleging that being the trainers of Old Boys an acceptor for Race no. 5 at the meeting they failed to notify a change of gear by the required time.

At the meeting held on 14th March 2008 the Stipendiary Stewards lodged an Information against licensed trainers, M & T Stokes, under Rule 868 (5) (a) alleging that being the trainers of Old Boys an acceptor for Race no. 5 at the meeting they failed to notify a change of gear by the required time.

At the outset of the meeting the Committee noted that the Defendants admitted the breach and did not wish to appear. This being confirmed in writing.

For the Stipendiary Stewards, Mr Ching advised that the time for advising of change of gear for the meeting was 11.00 a.m. on Wednesday 12 March 2008 and sometime after that date the Stipendiary Stewards were contacted by Mr Stokes advising that they wished to have Old Boys race in blinkers at the meeting today. Mr Stokes told the Stipendiary Stewards the reason for the request was a safety issue in that he thought the horse would race much better with that gear on and it was an oversight on his part in not notifying of the change by the required time. The Stipendiary Stewards advised that they accepted the explanation and had allowed Old Boys to start in the race.

The charge is found proven and in respect of penalty Mr Ching indicated that the Stipendiary Stewards were seeking a monetary penalty only. After giving credit to the Defendants for their early guilty plea the Committee takes the view that a fine of $50.00 is appropriate and a fine of that amount is imposed.
