Following the running of Race 4, Kaikoura Building Centre ITM Handicap Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr W E Higgs, alleging that Mr Higgs “presented his runners into the birdcage [for Race 4] with the incorrect numbers”.



Following the running of Race 4, Kaikoura Building Centre ITM Handicap Trot, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr W E Higgs, alleging that Mr Higgs “presented his runners into the birdcage [for Race 4] with the incorrect numbers”.

Mr Higgs had signed the Statement by the Defendant endorsed on the information form indicating, firstly, that he admitted the breach of the Rule and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 849 (2) provides as follows:

--

The trainer, horseman or person in control of each horse in the race shall ensure that the proper numbered saddlecloth is attached prior to the horse parading in the assembly area.

Mr McIntyre stated that Stipendiary Steward, Mr S P Renault, had been on duty in the birdcage prior to Race 4 and had noticed that the saddlecloth numbers on the two runners trained by Mr Higgs, JANI FRANCO (1) and NOBLE GALLEON (4), had been transposed. The situation was rectified prior to the horses going out on to the track for the Race.

Mr McIntyre informed the Committee that the brand on JANI FRANCO, the winner of the Race, had been checked. Mr Higgs had been “very remorseful and very frank”, Mr McIntyre said. He recommended a fine of $100.

Mr Higgs was fined the sum of $100.
