Following the running of race 10 on the programme, an Information was lodged against Mr L M Robinson, the rider of Hand of Eight, alleging a breach of Rule 858(1)(a), in that he failed to weigh in as required by the Rules, after finishing in 5th place.

----Mr Robinson admitted the breach.
----The placings were: 1st - 3, 2nd - 2, 3rd - 8, 4th - 6, 5th - 10, 6th - 7.
----Prior to the commencement of the hearing, the absence of the connections of Hand of Eight was questioned, and it was explained that trainer Mr Paul Harris had been made aware of the hearing but had not appeared.
----Explaining the circumstances, Stipendiary Steward Mr Ching said that, after finishing in 5th place on Hand of Eight, Mr Robinson failed to weigh in after the race and was located in the jockeys room. In explanation he said that he had been held up in the birdcage by the trainer, and also by the owner of the horse. Notwithstanding that, Mr Ching said it is the ultimate responsibility of the riders to weigh in.
----As far as penalty was concerned, he said that Mr Robinson had an exemplory record with only one warning for a previous similar breach. He recommended a moderate monetary penalty and, in accordance with Rule 523(3), forfeiture of the riding fee.

Mr Robinson fully admitted the breach and explained that, on his way in, he was called back by the trainer, and then directed to the owner in the public area of the birdcage fence. After speaking to him, he ?lost his way? but acccepted it was his responsibility.
----Penalty:
----In this case, Mr L M Robinson has admitted a breach of Rule 858(1)(a) in that, as the rider of Hand of Eight, he failed to weigh in, as required by the Rules, after finishing in 5th place.
----Mr Robinson has been open in his admissions and, as the circumstances have explained, we accept there are distractions that occur in the birdcage area, but the responsibility is on the jockeys to weigh in.
----Mr Robinson is a senior hoop and we give him credit for his excellent riding record and, clearly, his genuine remorse in this instance. However, the onus is on him, and he clearly accepts that. In the circumstances, we are satisfied that a moderate fine is appropriate in this case, and he is fined $150.00. We also order, under Rule 523(3), forfeiture of the riding fee.
----Request for a Ruling:
----Associated with this matter is the Request for a Ruling. Mr Ching stated that under Rule 856(1), any horse whose rider is required to weigh in, and does not, shall be disqualified and, as set out on the Information, he sought disqualification of Hand of Eight from 5th placing.
----In relation to that Request for a Ruling, under Rule 856(1) it is mandatory in these circumstances for Hand of Eight to be disqualified, and we so order. Accordingly, Hand of Eight is disqualified from its 5th placing, and the placings will now read:-
