--Mr Allison used the video to demonstrate that Mr Tither had used the whip at least 24 times from the straight entrance to the finishing line. Mr Allison did say that some were actually ‘dummy’ strokes.
Mr Tither admitted that he had struck the horse with “slightly too many hits” and that some were not strikes on the horse.
Senior Driver Mr B Orange commented that Mr Tither had made the correct decision by pleading guilty.
PENALTY
Before deciding penalty the Committee heard that Mr Tither had no previous charges of a similar nature and had, in fact, improved his driving over the past 6 months. Mr Allison suggested a fine range between $200 and $250. After discussion the Committee agreed that a fine of $200 was appropriate, taking into consideration both Mr Tither’s good driving record and his early guilty plea.
