Following the running of race five on the programme, an Information was lodged against Mr B Borcoskie, the trainer/driver of The Phantom Mee, alleging a breach of Rule 869(2)(a), in that he used his whip excessively in the run home. Mr Borcoskie
Following the running of race five on the programme, an Information was lodged against Mr B Borcoskie, the trainer/driver of The Phantom Mee, alleging a breach of Rule 869(2)(a), in that he used his whip excessively in the run home. Mr Borcoskie admitted the breach and elected not to be present.
----Explaining the circumstances, stipendiary steward Mr Ydgren said that Mr Borcoskie, driving The Phantom Mee, used his whip approximately 21 times in the run home - which the stewards consider is excessive - and he referred to the video of the race to show the breach. He said he explained to Mr Borcoskie that it was not the force that was used, but the number of times that it was used in the straight, without a break, and he recommended what he termed a standard, first offence penalty - a $200.00 fine.
----In written submissions, Mr Borcoskie explained that this was the first time he had been charged with excessive use of the whip and his horse did respond each time he hit him.

----In this case, Mr B. Borcoskie has admitted a breach of excessive use of the whip whilst driving The Phantom Mee in race five and the stipendiary stewards showed, using the film, that he used the whip not less than 21 times down the straight.
----With his having admitted the breach, it is up to this panel to determine an appropriate penalty and I am satisfied, acknowledging both Mr Borcoskieās submissions and the recommendations of the stipendiary stewards, that a fine of $200.00 is appropriate, given it is his first such offence. Accordingly, a fine of $200.00 will apply.
