Following the running of race 2 an information alleging a breach of rule 869 (2) (a) was filed the informant was Mr J.M.Muirhead and the defendant being Mr I . Brownlee.

Following the running of race 2 an information alleging a breach of rule 869 (2) (a) was filed the informant was Mr J.M.Muirhead and the defendant being Mr I . Brownlee. Mr Brownlee admitted the breach of this rule and signed the information that he did not wish to be present at the hearing of this information. The Information stated that horseman Mr I Brownlee used his whip excessively over the concluding stages of the race on Holmes The Charmer. The chairman requested the Registrar to ask Mr Brownlee to attend this hearing however the Registrar advised Mr Brownlee had left the course.

Mr Muirhead showed the video of the run home this video showing Mr Brownlee to drive Holmes A Charmer out to the finish of the race and being struck with the whip without any pause as per the guidelines as set out by HRNZ and endorsed by the Horsemans Association.

Mr Muirhead stated this was excessive and submitted submissions on penalty Mr Muirhead sought a fine in this instance and stated that Mr Brownlee had a good driving record and had not had a charge under this rule previously.

Having taken into consideration the submissions on penalty by Mr Muirhead and Mr Brownlee's good driving record a fine of $250.00 was imposed in this instance.
