Mr Laking has admitted a breach of rule 871(1)(d) in race 8 in that he permitted his mount LA CAPICHE to shift inwards near the 150 metres mark causing TOM THUMB, ridden by Mr Yuill, to check and fall. We thus find the charge proved.
----Mr Ching had Mr Barnsley demonstrate on the videos that LA CAPICHE, ridden by Mr Laking, had moved in when under the whip squeezing TOM THUMB which was racing on the inner of LA CAPICHE and on the outer of RACING SPIRIT ridden by Mr Bothamley, with TOM THUMB clipping heels and falling.
----The carelessness in the committee’s view consisted in Mr Laking being too late in stopping riding LA CAPICHE under the whip when that horse ducked in some 150 metres from the winning post. Mr Ching has described the breach as high to mid range. He has stated that movement by Mr Laking has caused the fall, but he has acknowledged in his submissions to the committee that there was some outwards movement by Mr Bothamley as well.
--This is a situation in the committee’s view where the consequences were high in that a horse fell, but Mr Laking’s culpability was in the medium range. The movement from LA CAPICHE was quite sudden and Mr Laking was simply too slow in taking the necessary action to straighten LA CAPICHE. We accept he did attempt to straighten his mount as it moved inwards towards RACING SPIRIT but, as he acknowledged, he was not aware that Mr Yuill on TOM THUMB was racing slightly behind and between him and Mr Bothamley.
----Mr Ching has asked for a suspension of 5 to 8 days. We take into account the nature and gravity of the incident, Mr Laking’s good riding record of 1 breach in the past year, and his ready admission of the breach. We believe a suspension of 6 days to be appropriate in all the circumstances. Mr Laking is already suspended until 9 January with regard to an earlier but unrelated matter. He is further suspended from that day up to an including 2 February 2008. This is 6 South Island days and includes the Premier Day at Wingatui. Mr Laking is reminded in no uncertain terms of his obligations to other jockeys under the Rules of Racing. There were clear safety concerns with respect to this incident.
