Following the running of race 5, the 99.0 Radio Live Handicap, Mr Bell was charged with careless riding under rule 638 (1) (d). The information alleged that “he allowed his mount REGAL RETURN to shift out causing BELLASDREAM to be jostled near the 200 metres”.

--Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”
--Mr Bell indicated on the information he admitted this breach of the rules. He also agreed he understood the charge and the rule it was laid under. As the breach of the rule was admitted the charge was proven.
--Stipendiary Steward Mr Goodwin showed the head on and side on videos of the incident. Mr Goodwin pointed out Mr Bell on REGAL RETURN and Vanessa Johnson to his outside on BELLASDREAM. He said Mr Bell was using the whip and moved out at approximately the 200m mark onto BELLASDREAM which in turn had slightly inconvenienced another runner. He said BELLASDREAM didn’t receive a check but was jostled and put off balance. He said Mr Bell continued to use the whip as his horse moved out and that he kept pushing his mount outwards until it made contact with BELLASDREAM. In making no attempt to stop riding or straighten his mount he said Mr Bell was guilty of careless riding.
--Mr Bell said that as LA MARINA, who was racing on his inside, moved out slightly his own horse being a little green had veered outwards. He agreed he had kept pushing out and caused the interference but once into the gap he then straightened up.
--Penalty Submission
--In relation to penalty Mr Goodwin said Mr Bell had recently returned to riding after suffering a serious injury earlier in the year. He had only had 4 rides since his return and had an excellent record prior to his injury. He said Mr Bell was a senior jockey who was trying to re-establish himself and whilst a period of suspension was appropriate he classed the incident at the low end of the scale.
--Ms Bell had no comment to make other than to say he had a confirmed ride in the Counties Cup on the premier day at the Counties meeting on 21 November 2009.
--Decision
--In coming to a decision on penalty the Committee considered the incident as shown on the video and all the submissions put before it. We have taken into account Mr Bell’s admittance of the breach and his excellent riding record prior to him suffering his injury earlier this year. However, the video clearly shows you did push out when not sufficiently clear of BELLASDREAM and that you did not stop riding and did affect the chances of that horse. We also agree the offending is at the lower end of the scale. We also note you are trying to re-establish yourself following your return to riding and that in doing so you will be riding at as many meetings as possible in the immediate future.
--Mr Bell is suspended from the conclusion of racing on Saturday14 November 2009 until the conclusion of racing on Friday 20 November 2009, that being 4 riding days.
