--| -- DECISION & REASON: --Following race 7 Stipendiary Steward Mr A R Coles applied for a ruling under Rule 912(1) regarding whether GENGHIS (T Russell) had been denied a fair start. ----Jockey Thomas Russell described what happened as the gates opened for the start. His mount was three in from the outside and he stated that although the gates had opened fully as the field was released in his case the gates had immediately closed again. This hindered GENGHIS which had to force its way out and as a result he estimated that cost him at least two lengths. This had left him at the back of the field when he had intended to race in a handier position. ----The incident was shown on video and the starter, Mr Trevor Harrison, confirmed that it had hindered GENGHIS as stated. ----Mr Coles submitted that the evidence and the video established that it had cost at least two lengths as alleged and recommended that the Committee exercise its discretion. Accordingly GENGHIS was declared a late scratching due to mechanical failure of the gates and under rule 912(1) refund of all investments was ordered. ------ -- -- --
