Decision:
Following the running of Race 7, Lion Beverages Mile, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr J S Bullard, alleging a breach of Rule 871 (1) (d) - the careless riding Rule - in that he “allowed his mount BALLAPHUN to shift in when not sufficiently clear causing THE FOX (T C Newton), SPEEDWAY (J R Todd) and LORD MATUA (L M Robinson) to check near the 1000 metres”.
Following the running of Race 7, Lion Beverages Mile, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr J S Bullard, alleging a breach of Rule 871 (1) (d) - the careless riding Rule - in that he “allowed his mount BALLAPHUN to shift in when not sufficiently clear causing THE FOX (T C Newton), SPEEDWAY (J R Todd) and LORD MATUA (L M Robinson) to check near the 1000 metres”.
Mr Bullard was present at the hearing of the information and indicated that he admitted the breach. The charge was found proved accordingly.
Mr M R Davidson showed video replays of the incident with approximately 1000 metres to run in the 1600 metres race. He pointed out Mr Bullard on BALLAPHUN, racing 4-wide and improving forward approaching the bend out of the back straight. Racing 3-wide was THE FOX with SPEEDWAY on its inside and LORD MATUA on the fence behind those runners. Mr Bullard then dictated THE FOX inwards on to SPEEDWAY which, in turn, was dictated on to LORD MATUA, the latter hitting the running rail. Trailing runners STARK HORIZON (A M Mundy), MARTINA (J B McDonald) and LEGALIGN (B Moore) were also inconvenienced in the incident, Mr Davidson said.
--Mr Ching alleged that Mr Bullard was not his own length and another length clear of Miss Newton’s mount. In fact, the Stewards believed that he was only ¾ to 1 length in front of Miss Newton’s mount.
--Mr Bullard said that the field was “rolling in to the corner”. As he had reached the corner, his mount had moved in just enough to tighten up THE FOX. It was an awkward angle coming in to the bend from the outside, he said.
--In relation to penalty, Mr Ching informed the Committee that Mr Bullard had not breached the careless riding Rule in the previous 12 months. The breach was “in the high range” – there was “severe interference” to the horses inside of Mr Bullard and it was fortunate that a fall had not ensued. Rider safety had been compromised, Mr Ching said. He submitted that a term of suspension of between 5 and 7 days should be imposed.
--Mr Bullard informed the Committee that he had engagements to ride at the Meeting of Oamaru Jockey Club on Sunday, 26 July. He pointed out that there were two premier days at the upcoming Riccarton meeting.
--In determining penalty, the Committee took into account, as mitigating factors, Mr Bullard’s admission of the breach and his good riding record. However, aggravating factors were that the breach was, clearly, at the high end of the scale and, as a consequence of Mr Bullard’s carelessness, as many as six runners received interference. It was fortunate that no runner was brought down as there was potential for a very nasty incident.
--The Committee believed that the appropriate starting point for the particular breach was a term of suspension of 6 days. Mr Bullard was entitled to a discount of one day for his guilty plea and his good recent riding record.
--Accordingly, The Committee suspended Mr Bullard’s jockey’s licence for a period commencing after the conclusion of racing on Sunday, 26 July 2009, up to and including Thursday 20 August 2009 – effectively 5 riding days.
