Evidence:
Following the running of Race 3 the “Hydroflow Mobile Trot” an Information was filed by Stipendiary Steward Mr S Renault alleging a breach of Rule 869 (4)(6)(b)(c) by Open Driver Mr M Edmonds. The Information stated that “Driver M Edmonds (Ruth Celeste Petite) shifted outwards forcing (Dolly Jones) G Smith to race wider on the track near the 1400 metres breaching the Push Out Rule”.
The Hearing of this Information was adjourned Sine Die from the NZMTC meeting on Friday 24 May and heard this day 26 May 2019 at the Rangiora HRC meeting at Rangiora.
Mr Edmonds had signed the Information admitting the breach and that he did not wish to be present at the hearing of the Information.
Rule 869(4)(6)(b)(c) reads as follows.
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and /or any other horse or its progress.
(6) “Subject to sub-rule (4) hereof: -
(b) A horse making a forward movement during any race shall not be forced to race wider on the track;
(c) A horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.”
Mr Renault used the race videos to indentify Mr Edmonds racing 4 back against the markers passing the 1600 metres, Mr Weaver who was trailing Mr Edmonds, and Mr Smith who was outside Mr Weaver. He pointed to Mr Edmonds begin to move outwards to the running line as Mr Smith was improving into the same position, this resulted in Mr Smith being forced 3 wide. Mr Renault explained Mr Edmonds realised this had happened and pointed to Mr Edmonds looking to the inside to move back, but Mr Weaver had improved into the position left by Mr Edmonds and by then the damage was done.
Decision:
As Mr Edmonds admitted the breach the charge was found proved.
Submission for Penalty:
Mr Renault stated Mr Edmonds had a clear record in relation to the rule and admitted the breach at the first opportunity.
He said given the mitigating factors in this case the Stewards felt Mr Edmonds deserved some discount from the normal starting point of a $250 fine.
Reasons for Penalty:
The JCA Penalty Guide provides a starting point for a breach of this rule of five drives, or a fine of $250. This Committee determined that a fine is an appropriate penalty in this case.
There are no aggravating factors to consider. In mitigation, Mr Edmonds’s good record and frank admission, the Committee can afford him a discount of $50.
Penalty:
Accordingly, Mr Edmonds is fined $200.
