Decision:

Following the running of Race 7, the Sydenham Bakery Ltd Mobile Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Graduation Horseman Mr B. A. Rennie, the driver of “Evanderman” (11), under Rules 869(4) and (6)(b) and (c), alleging a breach of the push out rule with about 1800 metres to run. 



Following the running of Race 7, the Sydenham Bakery Ltd Mobile Trot, an information was filed by Stipendiary Steward Mr N. M. Ydgren against Graduation Horseman Mr B. A. Rennie, the driver of “Evanderman” (11), under Rules 869(4) and (6)(b) and (c), alleging a breach of the push out rule with about 1800 metres to run.

Mr Rennie had indicated on the Information that he admitted this breach of the Rules, and he also agreed that he understood the charge and the Rule it was brought under.

Mr Ydgren gave evidence and used video coverage to show that with about 1800 metres to run Mr Rennie had moved outwards, and in doing so had shifted Modern Touch (7), driven by Mr T. S. Chmiel, and “Good Hest” (9), driven by Mr  M. P. Edmonds, wider on the track.

Mr Rennie did not dispute the facts of this matter.

Penalty:

Mr Ydgren advised that Mr Rennie had no previous relevant convictions, and as he had admitted the breach a fine of $200-00 was recommended.  Mr Rennie said that he preferred a fine to a suspension.  We were satisfied that a fine of $200-00 was appropriate in this case, and accordingly Mr Rennie was fined the sum of  $200-00.
