As a result of Licensed Jockey weighing in at the conclusion of Race 3, 1 kilogram in excess of his weigh out weight of 53.5 kilogrammes, Mr Khairil was charged pursuant to Rule 648(5) of the Rules of Racing.

Mr Khairil admitted the charge which is therefore deemed to be proved.

FACTS

--

Mr Khairil’s carded weight was 55.5 kilogrammes.  However, he is a 2 kilogramme claim apprentice and therefore, his official weigh out weight was 53.5 kilogrammes.

After Race 3, at the weigh in, Mr Khairil’s weight was found to be 1 kilogramme in excess of his weigh out weight, namely 54.5 kilogrammes. 

--

By way of explanation, Mr Khairil said that he had been wasting hard and that having weighed out, he then had a drink and that was the only explanation that he could offer for his increase in weight.  He told the hearing that it was approximately one half hour between his weighing out and weighing in at the conclusion of the race, during which time he had a drink.

PENALTY

--

Mr Oatham advised the hearing that Mr Khairil has not been charged pursuant to this Rule before.  He recommended that a fine in the region of $200 to $300 was appropriate.

Mr Khairil did not have any submissions to make with regard to the question of penalty.

--

After giving due consideration to the matter, we considered that a fine was appropriate.  It was an unusual case in that Mr Khairil put on so much weight in such a short period of time.  As a result of this, his mount was not, as we perceive it, disadvantaged to any great extent but neither did it gain any advantage as a consequence.

In the circumstances, we consider that a fine of $200 is appropriate, and Mr Khairil is fined that sum accordingly.
