Following the running of Race 8, Tuskers Elmwood Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw, as the driver of WOODLEA LIFE in the race, "after approximately 500 metres shifted down into the trail when there was insufficient room

DECISION AND REASONS:

--

Following the running of Race 8, Tuskers Elmwood Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr S P Walkinshaw, alleging that Mr Walkinshaw, as the driver of WOODLEA LIFE in the race, "after approximately 500 metres shifted down into the trail when there was insufficient room, resulting in A Edmonds (SOONENUFF) having to restrain".

Mr Walkinshaw admitted the breach and waived the right, as a Junior Driver, to be assisted by a senior horseman. The breach was found proved.

Mr B D Williams Assistant Stipendiary Steward, who had viewed the race from the patrol box at the entrance to the straight, showed video replays from several angles of the incident. He showed that KAIAPOI LIL, which had drawn 1 at the mobile 1050 metres start, had held the running line and attempted to stay in front. WOODLEA LIFE had challenged for the lead but, when it became apparent that it was not going to get the lead, it was restrained. At this point, Miss Edmonds on SOONENUFF, which was trailing KAIAPOI LIL, had drifted but was coming back and, at all times, was less that a horse and cart length behind the leader. Mr Walkinshaw was looking across with a view to attempt to take a trail. Mr Williams said that he had heard Miss Edmonds call and observed she was attempting to maintain her position. Mr Williams said that, unless Miss Edmonds had restrained, Mr Walkinshaw would have come across on top of her. Thereafter, Miss Edmonds instead of being in the trail was, thereafter, 3-back on the marker line.

Mr McIntyre informed the Committee that Mr Walkinshaw had received a suspension for a breach of the same Rule in July 2005. Mr McIntyre recommended a fine of $300 or a suspension for a period of 3-4 days.

Mr Walkinshaw indicated that he would prefer a fine to a period of suspension and said that he was in a position to pay a fine.

Following a deliberation, the Committee delivered the following oral decision in relation to penalty:

--

"We have deliberated on the matter of penalty and we have had regard to the submissions of both of you. In the circumstances, we are prepared to impose a fine rather than deal with your licence, Mr Walkinshaw, but we feel that the penalty recommended by Mr McIntyre or the quantum of fine recommended by Mr McIntyre of $300 is appropriate for this particular breach so you will be fined that amount accordingly."
