Mr T Moseley, rider of SANTA ROSA DE LIMA, placed 4th by the Judge in Race 7 protested against the 2nd and 3rd placings of BALLYBRISTA BELLE and WALSHIE?S BOY seeking relegation under rule 876(1) on the grounds of interference near the 150 metre mark. The margin between 3rd and 4th was a long neck.

Mr Moseley demonstrated on the head-on and side-on videos that both BALLYBRISTA BELLE and WALSHIE?S BOY had changed ground in the straight forcing him to take hold of his mount. He said that he thought WALSHIE?S BOY had moved in slightly but after viewing the videos was now of the opinion that the main cause of the interference was a sudden outwards movement from BALLYBRISTA BELLE. He said the interference had cost him at least a long neck which was the margin between 3rd and 4th. He demonstrated that once he had gathered his horse again he had finished on strongly.

Mr Coles and Mr Holmes, trainer and rider, respectively, of WALSHIE?S BOY stated their horse had moved in only slightly and that the cause of the interference was BALLYBRISTA BELLE. Ms Bennett and Ms Williams acknowledged BALLYBRISTA BELLE had ducked out suddenly and Ms Williams said she was not aware of it at the time. But she questioned whether the interference to SANTA ROSA DE LIMA had cost it 3rd place.

Mr Ching, stipendiary steward, said he did not believe that WALSHIE?S BOY was responsible for any interference. He said interference had been caused to SANTA ROSA DE LIMA by the 2nd placed horse BALLYBRISTA BELLE shifting ground outwards. He emphasised that the margin was a long neck, the degree of severity of the interference, and when it occurred, had to be considered.

We find that interference to SANTA ROSA DE LIMA did occur and that the cause of the interference was a sudden outward movement from BALLYBRISTA BELLE. We are satisfied that WALSHIE?S BOY did not contribute to the incident and the protest against that horse is accordingly dismissed. In exercising our discretion and determining to relegate BALLYBRISTA BELLE to behind SANTA ROSA DE LIMA we observe that Mr Moseley had to stop riding for 5 strides at a critical stage of the race. It was some 120 metres from the finish and was at a time that SANTA ROSA DE LIMA was mounting a promising run. When Mr Moseley gathered his horse again it finished on strongly to finish only a long neck behind WALSHIE?S BOY. We believe that the interference cost SANTA ROSA DE LIMA 3rd place. The amended placings are: 7, 6, 12, 9.
