Following Race 10 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr A Coles, that WINEOCEROS placed first by the judge, interfered with the chances of LADY LIP placed second by the judge

DECISION AND REASON:

Following Race 10 an Information was filed pursuant to Rule 876(1) when it was alleged by the Informant, Mr A Coles, that WINEOCEROS placed first by the judge, interfered with the chances of LADY LIP placed second by the judge, approximately 150 metres from the post.

--

Mr Coles called Mr Oatham, Assistant Stipendiary Steward, to demonstrate both video films. He showed Mr Grylls on WINEOCEROS move out approximately 2 to 3 horse widths and in doing so bump Mr Lammas on LADY LIP, who was on his outside. Mr Oatham stated that Mr Lammas was hindered from using his whip for three or four strides, which cost him valuable ground. He also said LADY LIP ran home strongly after receiving the bump.

Mr B Lammas, rider of LADY LIP, said his mount was going straight and when Mr Grylls started using his whip this caused WINEOCEROS to move out and bump his mount which certainly cost him more than the winning margin.

Mr R Verry, trainer of LADY LIP, said his horse was travelling well and Mr Lammas had not even gone for the whip when he received bumping from Mr Grylls.

Mr Grylls, rider of WINEOCEROS said although both horses touched and his horse was running greenly at no stage did Mr Lammas get past him.

Mr Sanders declined to comment.

Mr Coles, in final submissions said that the contact caused by Mr Grylls did cost LADY LIP some ground, and asked the committee to closely look at the side-on film again.

DECISION:

--

The committee determined that interference did take place when WINEOCEROS came out and bumped LADY LIP approximately 150 metres from the finish. They had no doubt that the chances of LADY LIP finishing in a better place were affected.

In applying their discretion they were satisfied of the following ?

  1. LADY LIP as a result of the bumping from WINEOCEROS lost valuable ground and had to regain momentum. Mr Lammas was also hindered in his use of the whip.

  3. After losing this ground LADY LIP finished the race strongly to be beaten by a nose.

Because of these reasons the protest is upheld, and the placings are now
