Following the running of Race 5, NZI Koral Steeplechase, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Apprentice Jockey, Mr C J Parish, alleging a breach of Rule 530 (2) (b) in that Mr Parish “being the rider of TUHAWAIKI unecessarily (sic) used his whip inside the final 200 metres”.



DECISION AND REASONS:

Following the running of Race 5, NZI Koral Steeplechase, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Apprentice Jockey, Mr C J Parish, alleging a breach of Rule 530 (2) (b) in that Mr Parish “being the rider of TUHAWAIKI unecessarily (sic) used his whip inside the final 200 metres”.

Mr Parish was present at the hearing of the information and was assisted by Mr M R Pitman, Licensed Trainer. Mr Parish admitted the breach which was found proved accordingly.

Mr N J Goodwin, Stipendiary Steward, showed a video replay of the final 600 metres or so of the Race, a steeplechase over the distance of 4150 metres.  Mr Goodwin had Mr Parish confirm the position of his mount, TUHAWAIKI, which was “some distance from the leaders” entering the straight for the final time. It was obvious that the horse was a beaten runner at this stage. Mr Parish was “trying it” but it was obviously not going to figure in the placings, Mr Goodwin submitted. After jumping the final fence, the field had carried on towards the post. TUHAWAIKI was still a considerable distance from the second-last horse and not in contention at all. After taking the last fence, Mr Parish then struck his mount five times behind the saddle with the whip.

Mr Ching told the Committee that Mr Parish had breached the whip Rule on three previous occasions in the last 12 months:

Mr Ching described this record as “quite appalling”. He recommended a suspension of between 4 and 6 days on this occasion.

Mr Parish said he was “very sorry” for the breach but explained that he had believed that the Rule did not apply in jumping races. He said that Mr Pitman had now spoken to him advisedly concerning his use of the whip on this occasion. Mr Pitman explained, on Mr Parish’s behalf, that Mr Parish was under the impression that he had to ride his mount to the line. Mr Pitman said that Mr Parish acknowledged that he had done wrong and was “very remorseful”. He was a very promising young rider and had made a mistake.

The Committee took into account Mr Parish’s very frank admission of the breach, his obvious contrition and Mr Pitman’s submissions on his behalf. However, on the other hand, a significant aggravating factor was Mr Parish’s poor record under the whip Rule in the past 12 months’ period. It was necessary to impose a penalty that contained a deterrent element in this instance. After a consideration, involving both parties, of Mr Parish’s upcoming engagements, his apprentice jockey’s licence was suspended from after the conclusion of racing on Saturday 9 August 2008 up to and including Saturday, 16 August 2008 – effectively, 4 days.
