Following the running of Race 7, Copthorne Hotel Commodore Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr P J Howlett, alleging that Mr Howlett, as the driver of HARD ON THE WALLET in the race, drove carelessly

DECISION AND REASONS:

Following the running of Race 7, Copthorne Hotel Commodore Mobile Pace, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Junior Driver, Mr P J Howlett, alleging that Mr Howlett, as the driver of HARD ON THE WALLET in the race, drove carelessly in that he allowed that horse "to shift in with approx 800 metres to run checking ASHLEY ACE (G M Moody) resulting in trailing runners having to take evasive action".

Mr Howlett was present at the hearing of the information. He indicated that he did not wish to be assisted by a senior horseman at the hearing. Mr McIntyre informed the Committee that Mr J F Curtin had assisted Mr Howlett at the "preliminary investigation" of the charge and had gone through the information with Mr Howlett.

Mr Howlett admitted the breach and the charge of careless driving was found proved.

Mr N M Ydgren, Stipendiary Steward, showed the incident on a head-on video replay of the relevant part of the race. Mr Ydgren had viewed the incident from the patrol box at the end of the back straight. He pointed out Mr Howlett positioned behind ASHLEY ACE, which was parked. Mr Howlett then improved his horse 3-wide and moved round to the parked position. In crossing Mr Moody, Mr Howlett forced Mr Moody to take a hold of his horse. Mr Howlett continued to move in, as a result of which Mr Moody's horse was tightened and broke and checked several trailing horses.

Mr McIntyre informed the Committee that he had spoken to Mr Howlett concerning penalty and that Mr Howlett had indicated a preference for a suspension over a fine. Mr Howlett had not driven a winner, Mr McIntyre said, and therefore was unable to drive at the upcoming premier meeting at Addington (on 31 March). Mr McIntyre recommended a term of suspension taking into account the Methven meeting on 2 April and the Akaroa meeting on 9 April. The period may also include the Addington meeting on 7 April, which may not be a premier meeting.

Mr Howlett did not wish to say anything in relation to the incident or penalty, other than to confirm that he did prefer a suspension to a fine.

Having regard to the submissions of Mr McIntyre, Mr Howlett's admission of the breach and his preference for a suspension over a fine, Mr Howlett was suspended for a period of two weeks, up to and including Sunday, 9 April 2006.
