Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr A Coles, that Mr L Callaway, rider of TEXAS, permitted his mount to shift inwards near the 1000 metres when not sufficiently clear of BIBULOUS (M Walker) who clipped a heel and blundered.

Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr A Coles, that Mr L Callaway, rider of TEXAS, permitted his mount to shift inwards near the 1000 metres when not sufficiently clear of BIBULOUS (M Walker) who clipped a heel and blundered.

Mr Callaway admitted the breach.

Assistant Stipendiary Steward, Mr G Stewart demonstrated the video films which clearly showed Mr Callaway riding TEXAS at the 1000 metre mark move inwards when not sufficiently clear and take the rightful line of the horse BIBULOUS who clipped a heel and blundered.

Mr Callaway said that he had moved in 4 to 5 horse widths and after looking to his inner he thought he was clear and not expecting to cause interference.

--

Mr Coles submitted this offence was at the lower end of carelessness. He said the offence warranted a 4 day suspension.

--

Mr Callaway had incurred only one suspension in the last 12 months.

--

Mr Callaway said he had no upcoming commitments.

PENALTY:

The committee considered all submissions and before imposing a penalty took into account the following:

  1. Mr Callaway's guilty plea. --
  2. His good riding record. --
  3. Degree of carelessness which we believe was at the lower end of carelessness.
--

Accordingly we impose a suspension for Mr Callaway to serve starting after racing on 2 January 2009 and to conclude after racing on 6 January 2009. (4 days)
