Meet Title:
Nelson HRC - 14 January 2007
Race Date:
2007/01/14
Race Number:
Race 2
Decision:
Following the running of Race 2, a protest was lodged by the Stipendiary Stewards against horse number 2, Megasam (B Orange), placed 1st by the Judge, on the grounds of causing interference throughout the run home to horse number 5, Goodonyoumatildas
Following the running of Race 2, a protest was lodged by the Stipendiary Stewards against horse number 2, Megasam (B Orange), placed 1st by the Judge, on the grounds of causing interference throughout the run home to horse number 5, Goodonyoumatildas (K Barron), placed 4th by the Judge.
----The placings in the race were: 1st - No 2, 2nd - 8, 3rd - 7, 4th - 5, 5th - 1, 6th - 4.
----At the commencement of the hearing, the Stipendiary Stewards sought to amend the Information by also alleging interference by Megasam to horse number 8, Orse M Lea (J Curtin), placed 2nd in the race.
----Put to the parties, the amended Information was accepted and endorsed by Mr Orange, the driver of Megasam who, in representing the connections of the horse, did not contest the protest, attesting to such by endorsing the Information.
----This was confirmed by the owners, Messrs and Mesdames Bowden and Cooke, who were also present at the hearing.
------
Explaining the circumstances, Mr Escott referred to the video of the race. It showed that, in the run home, Megasam (B Orange) veered out sharply, checking both Goodonyoumatildas (K Barron) and, further out, Orse M Lea (J Curtin). Whilst Mr Barron was able to check down and get a run on the inside, Megasam again veered out, again checking Orse M Lea, before going on to win the race.
----The Stewards sought relegation behind Goodonyoumatildas, which had finished 4th.
----Confirming that he did not contest the protest, Mr Orange commented that the interference was very evident and the horse should be relegated. Agreeing, the connections had nothing further to add.

Decision:
----In summation, this protest under Rule 869 was brought by the Stipendiary Stewards following the running of race 2, against horse number 2, Megasam, placed 1st by the Judge, on the grounds of causing interference. The protest was not contested by either the driver, Mr Orange, or the owners, who were present in the room.
----I find, as agreed by the connections, that Megasam veered sharply across the track in the run home, causing interference firstly to both Goodonyoumatildas and Orse M Lea and, shortly thereafter, again to Orse M Lea. In the circumstances, because of the interference caused, I am satisfied relegation is appropriate.
----The protest is upheld and horse number 2, Megasam, is relegated from 1st place to 4th place, behind the affected Goodonyoumatildas. The placings will now read:-
----1. 8 Orse M Lea
--2. 7 Miami Rocket
--3. 5 Goodonyoumatildas
--4. 2 Megasam
--5. 1 Belles Babe
--6. 4 Masterpeace
