Stipendiary Steward Mr N G McIntyre alleged that horseman Mr R Moore used his whip excessively in the run home whilst driving ACE OF DIAMONDS. Mr Moore admitted the charge.

Video evidence confirmed that the horse had received at least 20 strokes of the whip in the straight. Mr Moore does not drive often and the length of the long grass straight was a probable cause of the offence.

Under Rule 1111 (1) (d) I find the charge proven.

Submissions as to penalty were heard and Mr Moore expressed a preference for a suspension and Mr McIntyre suggested he be suspended up to and including 17 February 2008 which is two race days that Mr Moore had intended going to. Giving credit for Mr Moore's clean record under this Rule and his ready admission of the charge, I suspend Mr Moore up to and including 17 February 2008.
