Decision:
Following the running of Race 10, Christchurch Casino New Zealand Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr R T May, alleging a breach of Rule 869 (2) (a) in that Mr May, as the driver of MONKEY KING in the Race, “used his whip in an excessive manner over the final 300 metres”.
Following the running of Race 10, Christchurch Casino New Zealand Trotting Cup, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Driver, Mr R T May, alleging a breach of Rule 869 (2) (a) in that Mr May, as the driver of MONKEY KING in the Race, “used his whip in an excessive manner over the final 300 metres”.
Mr May was present at the hearing of the information and indicated that he admitted the breach. The charge was, accordingly, found proved.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
A video replay of the Race from the straight entrance was shown to the Committee by Stipendiary Steward, Mr N G McIntyre. He pointed out Mr May following KIWI INGENUITY into the home straight and then angle wide on the track. From that point, Mr Escott alleged that Mr May had used his whip approximately 25 times in the run home. This was not disputed by Mr May.
--Mr Escott informed the Committee that Mr May had not breached the whip Rule in the previous 12 months. He referred to Mr May’s admission of the breach and the status of the Race and the stake payable. He recommended a fine of $350.
--Mr May told the Committee that MONKEY KING tends to “pull up” in the last 50 metres of a race when he passes other horses and this was the New Zealand Cup. He had never been charged with a breach of the whip Rule, he said.
--The Committee took into account Mr May’s admission of the breach and his previous excellent record. It also took into account the status of the race and the stake payable.
--Mr May was fined the sum of $350.
