Decision:

Following Race 2 a protest was lodged by Mr L Noble pursuant to Rule 876(1) when it was alleged that ENCANTADA or its rider placed second by the Judge interfered with the chances of TLINGIT placed third by the Judge.

Following Race 2 a protest was lodged by Mr L Noble pursuant to Rule 876(1) when it was alleged that ENCANTADA or its rider placed second by the Judge interfered with the chances of TLINGIT placed third by the Judge.

The interference occurred in the final straight.

The Judges margin between second and third was a head.

Present were Mr L Noble and Mr C Lammas representing TLINGIT

Mr B Wallace and Mr A Peard representing ENCANTADA

The informant, Mr L Noble, the trainer of TLINGIT demonstrated the video films and showed where in the last 200 metres ENCANTADA, ridden by Mr Peard, move out and bump his horse which clearly hampered him and in Mr Noble’s opinion cost him second placing. He said as there was only a head margin at the post and he believed the interference cost him more than that.

Mr Lammas, rider of TLINGIT, said he was definitely hampered by Mr Peard moving out and bumping him on three occasions which put him off balance, which in his opinion, cost him much more that the head margin at the post.

Mr B Wallace, trainer of ENCANTADA, said his horse was forced out into the line of Mr Lammas and with the tight racing and close margins all he wanted was consistency from the committee.

Mr Wallace commented that his horse had suffered interference earlier at the top of the straight.

Mr Peard, the rider of ENCANTADA, said he had to change ground to his outside for a run and that Mr Lammas continued riding to the line.

Mr George, when asked for his interpretation of the incident said it was clear on the film that Mr Peard did move out and make contact with Mr Lammas on two occasions. He believed that with the head margin at the post between second and third this might have affected the placings.

DECISION:

The committee determined that interference did occur in the final 200 metres when

ENCANTADA moved out and made contact with TLINGIT on two occasions. We are clearly of the opinion that the hampering received by TLINGIT did affect his chance finishing in a better place.

We uphold the protest because:

1/ The degree of interference received by TLINGIT

2/ The tight margin of a head between second and third at the post.

Accordingly the placings shall now be:

1st 4 NUKE TIME

2^nd 5 TLINGIT

3rd 13 ENCANTADA

4th 1 CONCERTO

5th 6 RAID
