Following the running of Race 5, the Canterbury Draught Maiden, Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 871(1)(d) alleging Jockey C. Ormsby (Akaroa) rode carelessly.

DECISION AND REASONS:
--Following the running of Race 5, the Canterbury Draught Maiden, Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 871(1)(d) alleging Jockey C. Ormsby (Akaroa) rode carelessly.
--Present at the hearing were Mr Ormsby, an Apprentice Jockey, and Mr T. Hazlett who assisted Mr Ormsby at the hearing. Mr Ormsby had indicated on the information that he admitted the breach of this rule, and he confirmed this at the hearing.
--Stipendiary Steward Mr Humphries illustrated this incident by means of video coverage, and showed that Mr Ormsby had moved outwards as described in the information.
--Mr George said that the chances of both "Star Alliance " and "Maruia Springs" had been affected, and that carelessness was in the middle range.
--Mr Hazlett said that although the charge was admitted he believed that the breach was at the lower end of the scale. Mr Hazlett also said that the horse was difficult to ride and this might have contributed to the incident.
----PENALTY: In relation to penalty Mr George advised that Mr Ormsby has had six suspensions for careless riding since October 2005, the most recent being on 25 August this year. Mr George also said that throughout the course of the enquiry he had been impressed with Mr Ormsby's evidence and his forthrightness, and also with the assistance given by Mr Hazlett. Mr George said that a suspension was necessary in this case, especially considering Mr Ormsby's poor riding record.
--Mr Hazlett said of recent times Mr Ormsby has had 3 months on the sidelines during which time there had been hard work on both Mr Ormsby's riding and his personal demeanour and forthrightness. Mr Hazlett asked that it be taken into account that Mr Ormsby is doing his utmost to improve the situation he is in.
--There was also a discussion about the meetings that Mr Ormsby would be riding at in the future. The meetings coming up from 13 September 2006 were read out and Mr Ormsby and Mr Hazlett confirmed that Mr Ormsby would be riding at all available meetings in the near future. Mr George said that he was aware that Mr Ormsby did attend most meetings taking place in New Zealand, and he did not dispute that this would be Mr Ormsby's intention in the near future.
--We adjourned to consider the matter of penalty.
--DECISION ON PENALTY: On returning to the Enquiry Room we gave the following oral decision on penalty.
--"Having heard the submissions on penalty we are satisfied that a suspension is necessary in this case. In Mr Ormsby's favour we take into account ?

- The guilty plea; and --
- Also Mr Hazlett's submission re the improved attitude of Mr Ormsby and his endeavours to avoid breaches of the Rules. --
- We also take into account the Stipendiary Steward's view that this breach was at the middle range of the scale, although I don?t think those were your exact words.

On the other hand we must also take into account the previous breaches of
--this Rule over the last year.
--Taking all these matters into account we have decided that a 5 day suspension would be appropriate, but have reduced this to a 4 day suspension because of the guilty plea. This suspension is to commence after the completion of racing this Sunday the 10 September 2006 to after the completion of racing on Sunday the 17 September 2006, this being a 4 day suspension."
