Decision:

Following Race 10 an Information was filed pursuant to rule 871 (1) (D).  The Informant, Mr A Coles, alleged that Mr M Coleman, rider of DANIZELLE, allowed his mount to shift inwards near the 800 metre when not sufficiently clear of PORELLO (S Collett) who was checked.

Following Race 10 an Information was filed pursuant to rule 871 (1) (D).  The Informant, Mr A Coles, alleged that Mr M Coleman, rider of DANIZELLE, allowed his mount to shift inwards near the 800 metre when not sufficiently clear of PORELLO (S Collett) who was checked.

Mr Coleman pleaded guilty and did not wish to present at the enquiry.

Mr J Oatham demonstrated the video films which showed DANIZELLE moving in from a 2 off position to finish on the inside rail.  This movement occurred at the 800 metres and resulted in Miss Collett having to check her mount.  It was evident Mr Coleman was not the required distance clear when moving in.

Mr Coleman in admitting the charge said he was unaware Miss Collett was there and at no stage did she call to him.  He said it was a slight error of judgement on his part

PENALTY SUBMISSIONS:

Mr Coles said Mr Coleman had a very good record with only one suspension this year.  He said this was an error of judgement but at the lower end of carelessness.  Mr Coleman told the Committee he had commitments until the conclusion of racing on 29 August 2009.

PENALTY:

The Committee considered all evidence and submissions and in particular the following:

--

• Mr Coleman’s guilty plea
• His excellent record
• His level of carelessness which we find to be at the lower end
• The check received by Miss Collett and the amount of ground she lost

--

Accordingly we suspend Mr Coleman from riding in races from after the conclusion of racing on 29 August until after the conclusion of racing on 5 September 2009.  (4 days)
