Following the running of Race 1 Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 530(2)(b) alleging Jockey Miss J. Cameron, who rode "Our Gus", used the whip excessively prior to the 200 metre mark.

DECISION AND REASONS:

Following the running of Race 1 Stipendiary Steward Mr C. J. George laid an information pursuant to Rule 530(2)(b) alleging Jockey Miss J. Cameron, who rode "Our Gus", used the whip excessively prior to the 200 metre mark.

Present at the hearing were Miss Cameron and Mr R. Beckett, the trainer of "Our Gus". Miss Cameron had indicated on the information that she admitted this breach of the Rules, and she confirmed that at the hearing.

Mr Humphries used video coverage of the incident to show that Miss Cameron had used her whip almost continuously up to the 200 metre mark. The guidelines for use of the whip up to the 200 metre mark require that the whip can be used six times and then there must be a period of respite before the whip can be used another six times and so on.

In explanation Miss Cameron said that she was well aware of the guidelines but that on this occasion she had mistaken the position of the 200 metre mark. Mr Beckett said that it was necessary to ride "Our Gus" hard to get the best out of him.

In relation to penalty Mr George advised us that Miss Cameron had a previous conviction for breaching this rule on 1 January 2006. Miss Cameron confirmed this conviction. Mr George submitted that this breach could be dealt with by means of a fine.

Miss Cameron said that she had been working hard to improve the way she used the whip. She also said that she would prefer a fine to a suspension.

We adjourned to consider the matter of penalty. On returning to the Enquiry Room we gave the following oral decision on penalty.

"We have listened to submissions on penalty, and have also looked at penalties for previous breaches of this Rule. We take into account that this is a second breach in the last 12 months, and also take into account your guilty plea. A fine of $300-00 will be imposed in this case."
