The Information alleges that It's My Choice placed 2nd by the Judge interfered with the chances of Penny Collector placed 3rd by the Judge.
The Information alleges that It's My Choice placed 2nd by the Judge interfered with the chances of Penny Collector placed 3rd by the Judge.
--The margin between It's My Choice and Penny Collector was a nose.
--The rule was read and those present acknowledged that they understood same.
--Mr Hrstich demonstrated Head-on and Side on films of the alleged incident and gave his interpretation of same. It was his view that It's My Choice moved out onto his his horse Penny Collector making contact and unbalancing his horse.
--Miss Cooper had no questions of Mr Hrstich and subscribed to his theory
--Both riders namely Patrick Holmes It's My Choice and Jason Symes Penny Collector confirmed the foregoing comments.
--Mr George in summing up said it was his view that It's My Choice had effected the chances of Penny Collector and the margins between the two horses was only a nose.
--Those present were happy that they had a fair hearing and had nothing further to add and left the Judicial Room for the Committee to arrive at a decision.
--The Committee when arriving at a decision took into account all of the evidence both verbal and the films shown to them, and were of the opinion that interference had occurred when It's My Choice made contact with Penny Collector and such interference cost that horse ground.
--They then exercised their discretionary powers and placed It's My Choice behind Penny Collector .
--The amended placings were ? 6. 18. 3. 5. 12 .15
