At the conclusion of race 6, The Bent Pin Investments Handicap Trot, a protest was lodged by   Stipendiary Steward  Mr C Allison under rule 870 (5) alleging that with approximately 30 metres to run DEMON DARB (A Hunter) broke and was lapped on by WINFIELD GLOW (R Tither) and SOMERTON BEAU (B Barclay).

At the conclusion of race 6, The Bent Pin Investments Handicap Trot, a protest was lodged by   Stipendiary Steward  Mr C Allison under rule 870 (5) alleging that with approximately 30 metres to run DEMON DARB (A Hunter) broke and was lapped on by WINFIELD GLOW (R Tither) and SOMERTON BEAU (B Barclay).

Rule 870 (5) states “Notwithstanding the provisions of sub-rule 4 hereof any horse which is not in its correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in their correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then such relegation of the horse shall be at the discretion of the Judicial Committee”.

Mr Hunter did not contest the protest.

Mr Allison showed several video clips of the alleged incident highlighting the finish of the race and the horses WINFIELD GLOW and SOMERTON BEAU lapping onto DEMON BARB.

 Decision

--

The committee was satisfied a breach of the rule had occurred and as a result the protest was upheld.  DEMON BARB, originally placed 4th by the Judge was related to 6th placing with WINFIELD GLOW being promoted to 4th placing and SOMERTON BEAU promoted to 5th placing. The amended placings of the race were 1st 6, 2nd 2, 3rd 10, 4th 1, 5th 11 and 6th 13.
