Following the running of race 1 an information was lodged instigating a protest against Star General (no. 4), trained and driven by K Townley, alleging that in the final 200 metres of the race Star General broke and was out of its gait for in excess of 50 metres.

The relevant rules read:
--Rule 870 (3): Any horse which breaks from its gait shall promptly regain its proper gait.
----
Breaking Horses:
--Rule 869 (b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

At the outset of the hearing it was noted that the connections of Star General did not contest the protest and were not present at the hearing.

The Stipendiary Stewards showed their video evidence of the incident and it was pointed out where Star General left its gait and where it regained its gait and that the distance covered in terms of the marker pegs and the distance between them was in excess of 70 metres.

Having viewed the video the Committee is satisfied that the distance that Star General travelled while out of its correct gait was about of 70 metres which is in excess of the distance allowed under the breaking rule regulations. It was noted that Mr Townley attempted to have the horse regain its proper gait and did so some 10 – 15 metres prior to the winning post.

In the circumstances the Committee disqualifies Star General from fourth placing.
