Stipendiary Steward Mr T TAUMANU lodged an information against Junior Driver V Blanchard following Race 7, under Rule 869 (2) (a).  He alleged Mr Blanchard used his whip in an unnecessarily excessive manner on his horse LE SPOT over the concluding stages of the race.

Mr Blanchard appeared for the hearing and admitted the charge.  He was represented and advised by Horseman Mr M McKendry.

Mr Taumanu showed video footage of the run home which showed Mr Blanchard driving LE SPOT home to win by a nose.  The whip was being used with considerable force without abatement and was clearly excessive. The Industry would not condone excessive use of the whip.

He suggested a fine in the region of $200 for a first offence of this nature.

Mr McKendry said that Mr Blanchard had driven his first winner in the race and felt that his whipping of the horse had been crucial for the outcome.  Mr Blanchard had admitted the breach but as a junior driver drove infrequently and was not well paid.  He should have been celebrating his first winning drive rather than being in front of the Committee.

Taking all matters into consideration including the submissions of both parties Mr Blanchard is fined $100.
