Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that BEAN ROCK (T McMullen) shifted in near the 700 metres dictating DALLMAY (N Collett) in onto PRINCE KAAPSTAD (S Spratt) who then moved into the line of WORTH EVERY CENT (L Innes) who received a sharp check.

DECISION & REASON:

Following race 8 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Mr J Oatham, that BEAN ROCK (T McMullen) shifted in near the 700 metres dictating DALLMAY (N Collett) in onto PRINCE KAAPSTAD (S Spratt) who then moved into the line of WORTH EVERY CENT (L Innes) who received a sharp check.

Miss McMullen pleaded guilty to the charge and was represented by her employer, Mr S McKee.

Mr M Williamson demonstrated the video films which did show Miss McMullen allow her mount to move in slightly when insufficiently clear of DALLMAY (N Collett) on her inside. This led to a concertina effect which resulted in WORTH EVERY CENT receive quite a severe check.

Mr McKee on behalf of Miss McMullen said that in his opinion HITMAN who was racing in front of Miss McMullen has come out slightly and contributed to the incident.

PENALTY:

Mr McKee asked the Committee to consider Miss McMullen’s inexperience, the mitigating factors and that this was her first ever charge.

Mr Oatham said that although Miss McMullen had only moved in slightly WORTH EVERY CENT did receive a severe check as a result. However, he confirmed this was her first charge, she had pleaded guilty and there were some mitigating factors in her favour. He believed a suspension was appropriate.

The Committee considered all submissions and took into account Miss McMullen’s inexperience, this was her first charge and the severe check suffered by WORTH EVERY CENT.

We also considered the mitigating factors, namely the outward movement of HITMAN and the somewhat over-reaction of N Collett on Miss McMullen’s inside. However, we are clearly of the opinion that the check to WORTH EVERY CENT would not have occurred if Miss McMullen had not allowed her mount to move in. Accordingly we impose a suspension to start after racing concludes on 3 November and finish after the conclusion of racing on 10 November (3 days).
