-- ---- Mr Ching, stipendiary steward, has alleged that ENDA DEAL or its rider placed 1st by the Judge interfered with the chances of BEACON HILL placed 2nd by the Judge, the interference occurring over the concluding stages. He has asked that ENDA DEAL be placed immediately after BEACON HILL pursuant to rule 876(1) of the Rules of Racing. The margin between 1st and 2nd was a 1/2 head.
--Mr Ching first called Ms Cropp, rider of BEACON HILL, who stated that on 2 occasions in the home straight ENDA DEAL came into contact with BEACON HILL. She said ENDA DEAL came out and interrupted her run. Mr Ching then showed the side-on and head-on videos. He demonstrated that at about 100 metres from the finish ENDA DEAL came out and came into firm contact with BEACON HILL. He said BEACON HILL became unbalanced for a stride which cost the horse momentum. He emphasised the margin at the finish was only a 1/2 head. He also pointed to contact just short of the winning post but acknowledged that it was of lesser moment than the earlier contact. When questioned by the Committee, he stated that it was more difficult for a horse to regain momentum once unbalanced on a heavy track. Ms Cropp pointed out on the video that it was "decent contact" and that it had turned the backside of BEACON HILL around. She said it had cost her at least a 1/2 head.
--Mr McCann, rider of ENDA DEAL, accepted contact had occurred but said both horses were rolling around in the ground and that BEACON HILL had moved also. He said the incident cost both horses equally. Mr Gordon, trainer of ENDA DEAL, said both horses were struggling in the ground and that when the contact occurred BEACON HILL's head was in front of ENDA DEAL and that ENDA DEAL had also become unbalanced and that horse too had done well to pick up its momentum. He said his horse finished better than BEACON HILL.
--We are satisfied from the videos and the evidence of both riders that the chances and progress of BEACON HILL were interfered with by an outward movement of ENDA DEAL. The videos demonstrate that contact occurred 3 times in the home straight, with ENDA DEAL moving out onto BEACON HILL on each occasion. The first incident was just after the horses straightened and was of little moment. On the second occasion, some 100 metres from the post, there was clear firm contact between the horses. This was as a consequence of ENDA DEAL running out in quite a sudden movement. The contact was sufficient to turn BEACON HILL sideways for a stride. This was shown clearly on the head-on video. Ms Cropp did not appear to stop riding but we accept her statement that the incident did cost her horse momentum and that it finished on well after the interference. The third incident was close to the post and again there was clear contact. We accept this may have been too late to have interfered significantly with the chances of BEACON HILL. In exercising our discretion and relegating ENDA DEAL to behind BEACON HILL we take into account the fact that BEACON HILL clearly lost momentum in the second incident, and it was difficult for the horse to regain this on a heavy track. The margin was only a 1/2 head. In these circumstances we uphold the protest and the placings are reversed.
