Decision: Following the running of Race 6, the Mountain River Processors Handicap Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr J. D. Burgess, driver of SILVERDALE PRIDE (9), alleging a breach of Rule 869(4).
Following the running of Race 6, the Mountain River Processors Handicap Trot, an information was laid by Stipendiary Steward Mrs K. R. Williams against Mr J. D. Burgess, driver of SILVERDALE PRIDE (9), alleging a breach of Rule 869(4). The charge was that with about 700 metres to run Mr Burgess drove in a manner that interfered with, or was likely to interfere with, MOMO (11) which broke and lost its chance in the race.

Mr Burgess had indicated on the information that he admitted this breach of the Rules. He also agreed that he understood the Rule and the nature of the charge. and that the evidence given at the previous protest hearing would form the basis for this hearing.

In relation to penalty Mrs Williams advised that Mr Burgess had a clear record although he had received a warning in June 2007. Mrs Williams also said that this breach was in the mid to high range, and recommended a fine in the vicinity of $300-00 or a suspension of 4 – 5 days. It was established that Mr Burgess was only racing one horse at this time.
--Mr Burgess said that he would prefer a suspension to a fine.

I took into account Mr Burgess had a relatively good record and had pleaded guilty to the charge. I was satisfied that the period of suspension recommended was in the appropriate range, and advised that Mr Burgess’s Open Horseman’s Licence would be suspended from after the completion of racing tonight (29 February 2008) until after the completion of racing on 14 March 2008, this being effectively a 4 day suspension.
