An information was filed following race no 9. The informant was Mr J. M Muirhead and the allegation was that Trainer S Fenning was in breach of rule 864 (2) (d) in that Ms Fenning failed to affix the shaft extension so as not to come adrift on Lord Jake( Miss N. Chilcott).

M Muirhead and the allegation was that Trainer S Fenning was in breach of rule 864 (2) (d) in that Ms Fenning failed to affix the shaft extension so as not to come adrift on Lord Jake( Miss N. Chilcott). The right hand shaft was adrift for the majority of the race.
--M/s Fenning did not attend this hearing as she was unwell and Miss N. Chilcott attended for her Miss Chilcott with the permission of Ms Fenning admitted the breach of this rule in the absence of Ms Fenning.
--Mr Muirhead stated in his submissions on penalty that Trainer S Fenning had no breaches of this rule previously and Mr Muirhed recommended a fine of $200.00.
--Miss Chilcott on behalf of Ms Fenning thought $200.00 was a bit steep.
--Decision And Reasons.
--Having taken into account that the breach of the rule was admitted and the good record of Ms Fenning a fine of $200.00 was imposed in this instance.
